Vollio Terms of Service

Welcome to Vollio (formerly "Lingo Diary"; the "Service" or the "App"). This Service is provided by SPARKLECT CO., LTD. ("we", "us", or "our").

Please read these Terms carefully before using the Service. By registering an account or using the Service, you acknowledge that you have read, understood, and agreed to all terms below.

1. Nature and Scope of the Service

The Service uses generative artificial intelligence (generative AI) technology to provide a conversation-based language learning service that helps users practice and use their target language in a variety of contexts. The Service may include role-play, diary writing, language feedback, voice interaction, learning progress, and content sharing. Much of the content provided by the Service is generated automatically by AI and is for language learning reference only (see Section 3).

2. Accounts and Eligibility

  • Available sign-in methods are those currently offered on each platform.
  • You are responsible for keeping your account secure and for all activity under your account.
  • The Service is not designed for children under 13 years of age (or the age specified by local law). If you are under the age of majority in your region, you may use the Service only after your parent or legal guardian has read and agreed to these Terms.

3. AI-Generated Content and Disclaimer (Important)

Because the core functionality is AI-generated, we do not guarantee the absolute accuracy, completeness, appropriateness, or safety of generated content. By using the Service, you agree to assume the following risks:

  • Fictional content: The scenarios, characters, people, organizations, and events in role-play are fictional content generated by AI, and statements made by AI characters do not represent the positions or views of us or of any real person or institution.
    • Third-party intellectual property: All rights in third-party works, characters, or brands that appear in a scenario belong to their respective owners, and the Service is not affiliated with, licensed by, or sponsored by those owners. Such generated content is for personal, non-commercial language practice only, and you are responsible for ensuring your use does not infringe their rights.
    • Real people: The words and actions of any real person (including public figures) who appears in a scenario are fictionalized by AI. They do not represent that person's actual words, actions, or positions, and do not imply any affiliation with or endorsement of the Service by that person. We may modify or replace generated content involving real people.
    • Not professional advice: Even when a character in a scenario is a doctor, lawyer, police officer, interviewer, or similar, the conversation is for language practice only and does not constitute medical, legal, financial, career, or any other professional advice.
  • Language learning content: AI-provided rephrasing suggestions, grammar explanations, and translations are algorithmically generated references that may contain errors. They must not be used as the sole basis for academic examinations or professional translations.
  • Voice transcription and pronunciation teaching: Voice message transcripts, pronunciation annotations, and pronunciation teaching content are also AI-generated and may contain misjudgments or errors. They are provided for learning reference only and must not be used as the basis for language proficiency tests or professional assessments.
  • Goal evaluation and learning progress: Whether a stage goal is achieved, stage completion, and badges are determined automatically by AI or the system and may be inaccurate. They do not represent your actual language ability and do not constitute any certification of language proficiency.
  • Diary content: AI-generated diary content may not fully and accurately reflect your original intent. Users should verify the appropriateness of the content themselves.

4. User Conduct

The text, voice, and scenario settings you enter in the Service (including the location, your role, and the other character's role), and any scenario you share, must not:

  • Contain or be intended to generate sexual content, sexual content involving minors, graphic violence, terrorism, hate, discrimination, harassment, or content that promotes self-harm;
  • Impersonate or defame a real person, or infringe their reputation, privacy, likeness, or other rights;
  • Infringe anyone's copyright, trademark, or other intellectual property rights;
  • Engage in, encourage, or assist any illegal activity;
  • Deliberately manipulate, circumvent, or probe the AI's safety mechanisms, or cause the AI to generate content that violates these Terms;
  • Access, interfere with, or abuse the Service through automated scripts, emulators, reverse engineering, or other improper means.

If we reasonably determine that you have violated these rules, we may refuse to generate content, remove or take down the relevant content, restrict certain features, and, depending on the severity, suspend or terminate your account.

5. Beta and Membership Plans

5.1 Beta period

The Service is currently in a free beta:

  • During the beta, you may use the Service for free without a subscription, and you will not be charged anything.
  • Features, usage allowances, and service quality during the beta may be adjusted as development and operations require.
  • After the beta ends, the Service will move to a paid subscription model. We will notify you in advance before the beta ends through an in-app announcement or other appropriate means; the names, prices, and benefits of the official plans will be as announced at that time.
  • Unless otherwise announced, the account and content you created during the beta will be retained, but some features may require a subscription.

5.2 Membership plans

Once official plans launch, the Service will offer multiple membership tiers. The names, specific benefits, feature limits, and usage allowances of each plan are governed by the plan description page currently published in the App. We reserve the right to adjust plan content and values; if an adjustment adversely affects you as an existing subscriber, we will notify you before it takes effect.

6. Subscription and Payment Policy

This section applies once paid subscription plans launch.

6.1 Subscription fees

  • Subscription pricing, billing cycles (e.g., monthly, annual), and promotional offers are subject to the information shown in the app store (App Store / Google Play) and the in-app purchase page.
  • Prices may vary due to exchange rate fluctuations, regional tax laws, or promotional campaigns.

6.2 Auto-renewal

Subscriptions renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Charges will be deducted from your App Store or Google Play account within 24 hours before the end of the current billing cycle.

6.3 Cancellation

You may manage or cancel your subscription at any time through your app store account settings. After cancellation, benefits remain available until the end of the current billing period.

6.4 Refunds

All subscription transactions are processed by the app store platform (Apple / Google). The Service cannot process refunds directly. Please follow the relevant platform's refund policy.

6.5 Free Trial

Some subscription plans offer first-time subscribers a limited-time free trial (such as a 7-day free trial). The trial terms are as follows:

  • Eligibility: Trial eligibility is determined by the app store (Apple / Google) according to its account-level rules. Each Apple ID / Google account is typically eligible for one trial only.
  • Scope of benefits: During the trial, you may access the full features and usage allowance of the corresponding plan.
  • Automatic conversion to paid subscription: At the end of the trial, the subscription will automatically convert to a paid subscription and you will be charged according to the plan's billing cycle, unless you turn off auto-renewal via App Store / Google Play at least 24 hours before the trial ends.
  • Cancel anytime: You may cancel the subscription at any time during the trial. After cancellation, you may continue to use the benefits until the end of the trial period and will not be charged at expiration.

7. Fair Use Policy

To protect service quality for all users and prevent malicious abuse of system resources, the Service reserves the right to operate dynamic risk-control and rate-limiting mechanisms:

  • Dynamic limits: The Service may impose dynamic caps on short-term API call frequency, computational resource consumption, or abnormal usage patterns. These limits apply to all users (including beta users and both free and paid members) and are independent of your plan's usage allowance — abnormal behavior may trigger limits even when you still have allowance remaining.
  • Consequences when triggered: When the system detects abnormal usage patterns, it may temporarily restrict your usage privileges, reduce response speed, or ask you to try again later.
  • Rule adjustments: Limit quotas, calculation periods, and reset times may be adjusted dynamically based on system load without individual prior notice.

You agree that these limits are necessary measures to maintain service stability and do not constitute a breach of contract or infringement of your rights.

8. Intellectual Property

8.1 App rights

The Service interface design, source code, database structure, trademarks, and the official scenarios, images, and other content we provide are owned by us or our licensors.

8.2 User content rights

  • The content you enter in the Service (including conversation messages, voice recordings, and scenario settings) belongs to you. Content the AI generates for you based on your input (including scenarios, stages, character replies, and diary entries) belongs to you to the extent permitted by law.
  • To provide, maintain, and improve the Service, you grant us the necessary rights to process, store, and transmit your content during the operation of the Service.

9. Service Changes and Termination

We reserve the right to modify, suspend, or terminate any part or all functionality of the Service at any time. Significant changes will be announced within the App. You may stop using the Service and delete your account at any time.

10. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with the "Last Updated" date revised accordingly, and for significant changes we will notify you in the App. By continuing to use the Service after the changes, you agree to the updated Terms.
